5. DATA PROCESSING

In principle, we process personal data of our users only to the extent necessary for the provision of a functioning website and our content and services. The processing of our users' personal data regularly takes place only with the consent of the user. Exceptions are cases in which prior consent cannot be obtained for factual reasons and the processing of the data is permitted by law. The legal basis for processing personal data without the express consent of the data subject is Article 6 of the EU General Data Protection Regulation (GDPR).

This applies initially if this is necessary for the performance of a contract to which the data subject is a party. This also applies to processing that is necessary for the performance of pre-contractual measures. But also legal obligations that are subject to FORSIT. Rarely, but also not recorded, there is a vital interest of the data subject or another natural person in the processing of personal data. We hope that FORSIT will never find itself in such a situation. The personal data of the data subject will be erased or blocked as soon as the purpose of the storage is deleted. In addition, such storage may be provided for by the European or national legislator in EU regulations, laws or other regulations to which the controller is subject.

The blocking or deletion of the data will also take place after the expiry of a retention period prescribed by the aforementioned standards, unless there is a need for the continued storage of the data for the conclusion of a contract or the performance of a contract. Thus, there is no objection on the part of the user.

5.1 PROVISION OF THE WEBSITE AND CREATION OF LOG FILES

Each time our website is accessed, our system automatically collects data and information from the computer system of the requesting computer. The following data is collected here:

  • Information about the browser type and version used.

  • The user's operating system

  • The user's Internet service provider

  • The user's IP address (pseudonymized, shortened IP address)

  • The date and time of the access websites from which the user's system comes to our website

  • Websites accessed by the user's system through our website (external referrers are not shared within *.forsit.group)

The log files contain IP addresses or other data that allow an assignment to a user. This may be the case, for example, if the link to the website from which the user is accessing the website or the link to the website to which the user is switching contains personal data. The data is also stored in the log files of our system. This data is not stored together with other personal data of the user, as the temporary storage of the IP address by the system is necessary to enable the delivery of the website to the user's computer. For this purpose, the user's IP address must be stored for the duration of the session.

The storage in log files is done to ensure the functionality of the website. In addition, the data is used to optimize the website and to ensure the security of our IT systems. Collected data is deleted as soon as it is no longer required for the purposes of collection. When collecting data for the provision of the website, this is the case when the respective session is completed; when storing data in log files, this is the case after seven days at the latest. Further storage is possible. In this case, the IP addresses of the users are deleted or alienated, so that an assignment of the calling customer is no longer possible. The collection of data for the provision of the website and the storage of the data in log files are essential for the operation of the website. Thus, there is no objection on the part of the user.
